Ett praktikantavtal är ett skriftligt avtal mellan en praktikant och en arbetsgivare eller organisation som reglerar villkoren för en praktikperiod. Avtalet klargör vad som förväntas av båda parter och minskar risken för missförstånd.

1. Praktikens art och syfte

5. Ersättning

7. Arbetsmiljö och säkerhet

  • Företaget ansvarar för en säker arbetsmiljö för Praktikanten i enlighet med arbetsmiljölagen (1977:1160) och Arbetsmiljöverkets föreskrifter
  • Praktikanten ska följa arbetsmiljöregler, säkerhetsföreskrifter och eventuella interna rutiner
  • Innan praktiken börjar ges Praktikanten introduktion till arbetsplatsen, säkerhetsrutiner och brandskydd
  • Praktikanten omfattas av Företagets arbetsskadeförsäkring (eller motsvarande); vid utbildningspraktik omfattas studenten dessutom av Utbildningsanordnarens försäkringar för studenter under utbildning

8. Sekretess

Praktikanten förbinder sig att inte sprida eller använda Företagets eller dess kunders konfidentiella information utanför praktikens ramar. Sekretessåtagandet gäller även efter praktikens slut, dock i minst [3] år. Sekretessen omfattar inte sådan information som är allmänt känd, redan känd för Praktikanten innan praktiken, eller som måste lämnas ut enligt lag eller myndighetsbeslut.

9. Immateriella rättigheter

Eventuella resultat (texter, bilder, kod, ritningar, andra arbeten) som Praktikanten skapar i sin praktik och som har tydlig anknytning till Företagets verksamhet tillfaller Företaget i den utsträckning detta är tillåtet enligt lag. Praktikanten behåller upphovsrätten i den mån denna inte automatiskt övergår enligt lag, och beviljar Företaget en obegränsad rätt att använda resultatet i sin verksamhet.

10. Avtalets upphörande

  • Avtalet upphör automatiskt vid praktikperiodens slut
  • Båda parter kan säga upp avtalet med [två veckors] uppsägningstid om praktiken inte fungerar
  • Avtalet kan hävas omedelbart vid väsentligt avtalsbrott eller vid annat allvarligt skäl (exempelvis arbetsmiljöproblem, säkerhetsbrott eller olämpligt beteende)

11. Tillämplig lag och tvistlösning

Detta avtal regleras av svensk lag. Tvister som uppstår med anledning av detta avtal ska i första hand lösas genom förhandling mellan parterna. Om en överenskommelse inte kan nås ska tvisten avgöras av allmän domstol i den ort där Företaget har sitt säte.

Master Service Agreement

3. Fees and Payment
3.1 Fees. Customer shall pay Provider an annual subscription fee of Annual Fee (the “Subscription Fee”), payable annually in advance within Payment Terms of the invoice date.
3.2 Late Payment. Any amounts not paid when due shall bear interest at the lesser of one and one-half percent (1.5%) per month or the maximum rate permitted by applicable law.
4. Limitation of Liability
4.1 Exclusion of Damages. IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT.
5. Confidentiality
5.1 Confidential Information. Each party agrees to hold in confidence all Confidential Information of the other party disclosed under this Agreement. “Confidential Information” means any non-public technical or business information disclosed by one party to the other, whether orally or in writing, that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and circumstances of disclosure.

4.2 Liability Cap. Notwithstanding the foregoing, Provider's total aggregate liability under this Agreement shall not exceed the fees actually paid by Customer in the twelve (12) months preceding the claim.
5. Confidentiality
5.1 Confidential Information.
